BuskNY was proud to speak at Busker Ball 8, a showcase for the city’s most vibrant freelance performers, on Thursday. Under the direction of Theo Eastwind, the latest Busker Ball brought its focus to activism, criticizing the wrongful ejections, tickets, and arrests that have plagued the NYC subway performing community.

BUSKNY ART SHOW at Armature Art Space

BuskNY and Armature Art Space invite you to submit work for “SHOWTIME,” an exhibition of art made in and about the subway and public transit.

BuskNY is an arts advocacy organization that was created in 2013. Our mission is to generate broad awareness of the legality of artistic performance in the New York City subway, in order to end wrongful ejection, ticketing, and arrest of subway performers. While our primary focus is on musicians and performing artists, we also promote the creation, promotion, and sale of art by independent artists in the subway.

Through SHOWTIME, we will support visual artists whose work deals with or is made or sold in public transit and public space, with a particular focus on art made in the subway system itself. SHOWTIME will refocus the subway art dialogue on work made by independent artists, and publicly reemphasize that all New Yorkers can participate in the creative process.

Our partner, Armature Art Space, is a Bushwick gallery that showcases local artists using traditional media. Armature, which describes itself as “the support (or “armature”) on which artists can express themselves and around which artists may build community,” has graciously offered its gallery space free of charge.

The opening reception for SHOWTIME will feature refreshments and live performances by visual artists and prominent subway musicians.

7th Busker Ball

This Thursday we attended the 7th quarterly Busker Ball, an event organized by Theo Eastwind, in which some of the best buskers in New York performed at Williamsburg bar and music venue Spike Hill. Theo has been inviting us to speak about busker’s rights, distribute flyers and sell t-shirts for the past few Busker Balls.

Matthew Christian, back from Dakar, gave a presentation about BuskNY. Matthew outlined what we’ve done in the past year and our current projects, and announced our plans for the 2014 BuskNY T-shirt.

It turned out Matthew had left a cache of misprints of last year’s shirt in a drawer. We sold a few but gave most of them away to the performers.

Our design for this summer’s shirt. I’m planning on cleaning it up a bit and printing with four colors on dark colored shirts. I’m using a different technique of printing this time in which each layer will be hand-painted directly onto the screens without the need for photo emulsion or an exposure unit.

Following the success of last year’s Kickstarter campaign, we will be raising the money to make our new shirts free to all performers. We would like to include footage of a variety of buskers in our video, so if you would like to participate you can either send your own brief clips (webcam or phone video is fine) of yourself performing or speaking about busking and police harassment to milo@buskny.com, or contact us so that we can film you ourselves later in the month when we’re putting the video together.

The next Busker Ball is October 30th at 7:30 at Spike Hill!

2014 MUNY Auditions

Yesterday, Music Under New York held its 27th annual auditions in Grand Central Terminal’s Vanderbilt Hall. About 20 acts out of the 60 contestants will be chosen by a panel of 35 judges to be added to the MUNY roster. The auditions lasted five minutes each over the course of about six hours, and winners will be announced within the next few weeks.

We asked MUNY manager Lydia Bradshaw to make sure the legality of freelance busking was mentioned during this year’s auditions. Kalan and I attended the first few hours of the auditions to find out if our requests had been honored as well as to see some of the performances, and MUNY turned out to be quite supportive of our cause. We were unexpectedly invited into the press area where we found that MUNY had included a highlighted copy of MTA rule 1050.6 in the press packets for the event.

We stuck around to see the first 20 performers, and I managed to get close enough to get clear shots of most of them:


Based on some of the articles we’ve seen so far, not every member of the press has actually read everything in the packet, since some still conflate MUNY membership with a general busking license. BuskNY has been largely successful, however, when asking the authors of such articles to make corrections. If only informing the NYPD and general public that busking is legal were that easy!

But back to the auditions themselves: we’ll be looking forward to finding out who wins, and hope to run into all sixty of the contestants performing in the subway soon.

6th Busker Ball

Last Thursday was the 6th Busker Ball at Spike Hill, and BuskNY was there to give another report on the state of buskers’ rights in NYC.

Shiloh Levy gave a speech about the recent and planned further increases in enforcement of “quality of life crimes” (which results in increased enforcement of fictional laws as well.) Matthew asked me to check out Union Square a couple weeks ago and I went up and down every line; it was totally silent underground except for a single MUNY performer and a religious pamphlet table. Since then buskers have begun to return, but in smaller numbers, and I haven’t seen a churro vendor anywhere since.

Meanwhile Kalan, whose recent arrest has prompted some pretty bizarre political commentary as well as the more straightforward news coverage, arranged his equipment and assorted beasts, and ended the presentation with puppetry and balloon music.

In other news, last night I managed to make it down to open mic night at Goodbye Blue Monday for the first time since the place was saved from shutting down. In addition to coming out to the Busker Ball next time, I encourage everybody to check out GMB on a Tuesday night or whenever you can, and make sure the place doesn’t suddenly evaporate like Pearl Paint.

Theo Eastwind suggested we sell the leftover “Music is Legal!” t-shirts at the 5th Busker Ball last Thursday at Spike Hill so I went to set up a merchandise table and took a lot of blurry shots of the show. We even got one of our shirts pinned up to the curtain with Blueberry Season pins.

Shiloh Levy gave a presentation about buskers’ rights explaining what BuskNY is all about, followed by Heth of Heth and Jed who discussed his recent legal victory. I gave the last ten or so shirts to Arthur and Shiloh to distribute, so now I have room for the 2014 shirts. We learned a lot about what people want in a shirt from the first run, so I’m planning on doing something a little more complicated, and with a more inclusive message. There may be another Kickstarter campaign to raise funds for materials and equipment. I’ll keep you updated!

Goodbye from Matthew

I’ve had a busy last week, including having my violin repaired and finding this excellent tiny piano, which we brought to Coney Island:

For now it’s farewell! I’m taking off for Senegal this afternoon, and will be there on a Fulbright ETA grant until July 2014.

But that’s not the end of BuskNY. There’s a lot of interest, community-wide, in pursuing advocacy and publicity for public music in transit spaces. We saw that at our event at Armature Art Space on Monday the 7th, we see it with the visibility of “Music is Legal!” t-shirts underground, and we’ve seen it when a number of performers have recently stood up to articulate the MTA Rules to police.

So stay tuned. There will be new folks involved here soon, both with some blog posts and, we hope, with grassroots outreach using our printable flyers. Milo will be continuing the effort on visual art, with our eyes on a gallery show in fall 2014. And Kalan will be keeping up the fight to change problem stations – so please get in touch if you know of a problem with a particular station agent or spot. Keep up the music, and I’ll see you all in summer 2014!

86th St: meet the station agent who has everyone arrested

I got a tip from a performer recently about a problem at 86th and Broadway. He was able to be quite specific about the problem: apparently, the station agent on the weekday afternoon shifts calls police every time she hears music, which has led to a number of arrests.

I made a trip up there today to see what the problem was. The station agent was very forthcoming about having called the police because of music on the platform. I showed her a copy of the rules, which she said she had never seen before. After a careful reading of the section about permitted non-transit activities, she said she now shared my opinion, but that she would still call her supervisor when she heard music. (According to her, station agents are trained to call their supervisors whenever they hear music. Fact or fiction? Maybe FOIL can tell us).

At this point, I asked her to confirm her claim with the Music Under New York office at the MTA. Surprise, she said: she is only able to call her supervisor and no one else. She did, however, agree to “call someone” to “come sort this out.”

After a fifteen minute wait, who arrived but a police officer. I showed her the rules pamphlet and she agreed that I’d be okay playing in the station. (She did ask why I had taken a picture of the station agent’s badge, which is required to be displayed in window of every station booth. Apparently the station agent had complained, in her call to the police, that a member of the public had dared record her badge number. I’m sure the MTA will love to hear that an employee was retaliating for having her badge number recorded.)

The police officer then went into the station booth to speak with the station agent for a few minutes. When she came back out, she had changed her opinion: it’s not okay to play on the platform, she said, but only on the mezzanine and only with a “license.”

I then showed her the pamphlet again, and provided the MUNY phone number so that she could confirm that no license was needed. She was convinced regarding MUNY, but seemed to think that the sections mentioning noise and blocking traffic provided a blanket justification for arresting and jailing any performer who ever performs on 86th St between the hours of 1 and 9 PM.

There was only one thing to do at that point. I pulled out a copy of the settlement notice from my lawsuit and told her that the last police officer to share her opinion cost the City of New York thirty thousand dollars. That made her doubt herself again. She said she would check with her sergeant about the rules, and invited me in to the 59th St precinct to discuss the matter further.

The only problem there? Well, the sergeant in question once threw me out of 59th St for daring to show him a copy of the rules (itself currently the topic of a CCRB investigation). So I doubt that the issue will get a fair hearing — at least, that is, until my two arrests from this summer cause some lawsuits to land at the 59th St doorstep.

And as far as the station agent goes? I’ll be filing a complaint shortly about the badge number reprisal and the harassment of performers. Given that my complaint about harassment at 81st generated a personal phone call and a promise to speak with the employee in question, I have high hopes. 86th St, we’ll bring the music back yet!

Painting Underground: Chris Wright

Compared to musicians, we don’t encounter many visual artists in the New York subway system. Sure, the MTA has done significant work bringing visual art into public spaces, but we rarely see the process: even people sketching strangers on the train in little Moleskine notebooks are a rare sight. So I’m always excited to hear about somebody painting down there:

Chris Wright, the professor at Pratt who taught me how to paint with oils, has been posting pictures on his Tumblr blog of oil paintings he’s done on the G line platforms (as well as just about everywhere else!)
